Why / When do I need a lawyer?

Again it depends on the seriousness of the legal matter as to whether or not you require a lawyer. Sometimes Cox Legal provides you with advice to get you started in the wrong direction and you can handle the matter yourself, with some good guidance. On other occasions, the complexity of the matter might require a lawyer to navigate the matter so that you are working towards the best outcome for you.

If you are at the Police Station, please telephone Cox Legal for advice over the phone BEFORE YOU SPEAK TO POLICE.   Cox Legal recommends this so you can make an informed decision about your rights and obligations to Police.

Why should I engage Cox Legal?

Will Legal Aid pay for me?

A.

Legal Aid provides financial assistance for a range of matters including criminal proceedings, family law proceedings and other areas.

There are stringent requirements to qualify for Legal Aid and you are encouraged to contact Legal Aid Western Australia to determine if you qualify.

Alternatively, an application can be filed online at Cox Legal. Please ring and make an appointment to complete this. Cox Legal undertakes representation of Legal Aid matters without hesitation and Michelle Cox is an approved practitioner on the panel for Legal Aid in multiple areas of law.

How much will I have to pay?

A.

This is the million dollar question.

The short answer is, I do not know. Until I have spoken with you and identified your legal issues, it is impossible to offer anything other than an educated guess. On some occasions, however, a fixed fee can be provided.

Some of the factors which affect the overall cost can include :

  • The type of work your require whether it is civil litigation, representation in criminal proceedings, application for or objection to restraining order(s), debt recovery or other areas of law;
  • The court or jurisdiction that matter will be heard in;
  • Any filing fees as required by the Court to be paid such as application fees;
  • At the commencement of your matter, you will be provided with documentation setting out the anticipated feesl
  • Depending on the type of matter, you may be required to provide an “up front” payment in anticipation of your legal fees. This money will be deposited into the Cox Legal Statutory Trust Account and will be credited to you.       This money will only be accessed after you have been issued with a Tax Invoice from Cox Legal either during the progress of or at the conclusion of your matter.
